On June 14, 2023, Governor Kay Ivey signed the distracted driving legislation, Senate Bill 301, into law in Alabama. The new law makes is a secondary offense to hold a cell phone while driving, which includes talking on the phone. Handsfree use, or use a device such as a Bluetooth earpiece or other voice-activated device, are still legal to use.
Safe driving advocates feel that this is a good first step, but most would like to see tougher legislation enacted. As a violation under the law is considered a secondary offense rather than a primary offense, drivers can't be pulled over or cited just for using the device but must be pulled over for another violation, such as driving in a distracted manner or speeding.
Violators of the law can be fined $50 for the first offense and receive points on their driver license, and the law includes a 1 year grace period from the date that the bill was signed into law where violators will receive a written warning.
